Terms and Conditions

Below is listed a set of terms and conditions set by Castledex Pty Ltd  (The Site). By Purchasing from The Site you adhere to the following Terms and Conditions set by The Site. The Site may amend these Terms and Conditions from time to time of which any amendment will be effective immediately.

  1. Placing an order
    1. The products and Services made available by The Site are only available to those who are able to make legally binding contracts.
    2. Placing an order online is a legally binding contract, where the customer will be provided with a Tax Invoice following a Purchase order generated from the website.
    3. The Site reserves the right to cancel and refund any order at any time at The Site’s discretion
    4. Changes made to any order after the orders payment has been processed will incur a fee of $9.95AUD which will be paid by the customer
    5. Prices of products and services offered by The Site and other charges displayed on this website are current at the time of issue with Errors and Omissions Excepted, and may change at any time and are subject to availability.
  2. Payments and Refunds
    1. Goods are listed in Australian Dollars (AUD) and offered only to Australian customers
    2. All prices listed are inclusive of Goods and Services Tax (GST)
    3. Prices shown are exclusive of shipping costs
    4. Property and Ownership of the products will not pass to the customer until the full payment for the purchase has been received by The Site
    5. Failure to pay an order per The Site payment and shipping information schedule may result in debt collection measures taken by The Site to recover monies and the customer will be liable for any collection costs incurred
    6. Credit Card payments may incur a surcharge of 1%-3% depending on credit facility
    7. In the event that an ordered item is not available or we are unable to fulfil your order we will notify you within 2 business days to arrange an agreeable alternative item, a backorder or a full refund.
  3. Shipping & Handling
    1. The Customer must provide a valid shipping address
    2. The Site will use its best endeavours to ensure products are delivered on time
    3. The customer must ensure that an authorised signatory is present at the provided and specified shipping address upon delivery to accept the goods
    4. All orders will be subject to incurring a one-off shipping and handling fee of $11.00(AUD) inc GST for Perth Metro Areas. Outside of these areas the Shipping fee will be calculated  at an additional $1.50(AUD) inc GST per kilo. This fee may be subject to change without notice. EOE.
  4. Warranty Information
    1. Operating a product outside of the manufacturers documented specifications will void your warranty, including; incorrect voltage and other hardware modifications and non specified environments
    2. Failure to follow standard installation and operating instructions or failure to ensure adequate cooling will void warranty
    3. Physical damage to items may void manufacturers warranty
    4. Warranty is 12month return to base (Leederville, Western Australia) on all goods unless otherwise stated upon purchase of the product
    5. A fee of $44.00AUD inc GST will be incurred for products returned failing to comply with warranty or where no product failure is found
    6. Goods damaged in transit are only applicable for replacement or repair up to seven days from the date the product was ordered
  5. Cancellation
    1. Our cancellation policy is governed by the Australian Trade Practices Act (1974). You may cancel an order where the goods have been wrongly described, are different from the sample shown on the The Site website or on marketing information, or does not perform to the manufacturer’s specifications.
    2. Please choose your products carefully as we are under no obligation to honour our cancellation policy due to wrongful decisions
  6. Return of Products
    1. We are sympathetic to returns and will consider all requests which do not meet the below requirements on a case by case basis
    2. All items are packaged and checked to ensure that goods are delivered in a satisfactory condition
    3. Goods returned because of an incorrect choice may incur a restocking fee
    4. The Customer can return goods for a refund, repair or replacement only if:
      1. i.    The item has a fault that wouldn’t normally be detected at the time of purchase or match the product selected on the website
      2. ii.    The item is not the same as described by the salesperson, or on a label or sign, or in an advertisement, or does not match the sample shown.
      3. iii.    The item(s) at fault are returned within 6 months of purchase
      4. iv.    The items must be sealed so they do not leak or get lost in transit
    5. A Company Return Authority Number must be obtained before returning any product.
    6. A Company Return Authority Number is required for either faulty or non-faulty returns.
    7. The Site Return Authority Numbers can be obtained by contacting the Customer Service Department on info@castledex.com.au
    8. The Site will pay freight in the event incorrect products are shipped to the customer.
    9. Customers in all states and territories must return goods only by our nominated carriers; otherwise freight will not be paid by The Site.
    10. In the event that a customer is eligible under the return of product condition a credit note will be offered, valid for 12 months to be used on future purchases
  7. Resale
    1. Warranty and OEM licenses are non-transferable via resale.
  8. Reservation of Title
    1. The customer agrees that property and ownership in the goods will not pass to the buyer but will remain with The Site until payment of the purchase price of the goods and all other amounts owning to The Site by the purchaser have been paid to The Site. Until the customer has paid all the monies to The Site:
      1. i.    the goods are held by the customer as fiduciary bailee of The Site;
      2. ii.    the customer must not sell the goods except with the prior written consent of The Site or in the ordinary course of the customer’s business; and
      3. iii.    any proceeds of such re-sale, insofar as the relate to the goods, shall be held on trust for The Site in a separate account.
  9. Applicable Law
    1. These Terms and Conditions shall be governed by and constructed in accordance with laws of the state of Western Australia. You (the purchaser) and Castledex.com.au agree to submit to the exclusive jurisdiction of the courts of the state of Western Australia. If any provision(s) of these Terms and Conditions is held by a court of competent jurisdiction to be contrary to law, then such provision(s) shall be constructed as nearly as possible, to reflect the intentions of the parties with the other provisions remaining in full force and effect. The Site’s failure to exercise or enforce any rights or provisions of these Terms and Conditions shall not constitute a waiver of such right or provision unless acknowledged and agreed to by Castledex.com.au in writing.

10.  Limitation of Liability

  1. No liability whatsoever (except as provided by the law) will be accepted by The Site for any damages or losses arising from or as a consequence of either late delivery, misdelivery or non-delivery of goods or any other act or default on the part of The Site or any servant, agent or contractor of The Site in relation to this agreement unless the same occurs because of the wilful act or default or negligence of The Site, its servants, agents or contractors in which case liability is limited to the payment of the costs of having the goods or services supplied again.
  2. The Site’s liability is limited to the cost of the product purchased from The Site. All of the products sold are to be used at the customer’s own risk and The Site is in no way liable for any loss, damage or injuries suffered from installation or use.
  3. All images displayed are for illustrative purposes only, and all specifications shown are true and accurate to the best of our knowledge.

11.  Compatibility

  1. The Site is under no obligation to ensure compatibility between components. It is up to the customer to first research and confirms that a part will be compatible and suitable for their application prior to purchase.
  2. The Site will not be held liable for any damages or losses caused by compatibility issues.
